Terms of service

The agreement

These terms are an agreement between you and Intelligent Punks ("we", "us") for the use of KariSMMa, the social media management platform at portal.karismma.com, and the website at karismma.com. By creating an account or using the portal you accept them. If you use KariSMMa for a company or for clients, you confirm that you may accept these terms for them.

The service

KariSMMa lets you plan, create, approve, publish and analyse social media content for one or more brands, answer comments and messages, and use AI features. We may add, change or remove features over time. Where a change removes something important you rely on, we will tell workspace owners in advance where we reasonably can.

Accounts, workspaces and team members

You are responsible for your account and for what happens in your workspaces. Keep sign-in details safe, give team members only the role they need (Owner, Manager or Client approver), and remove people who should no longer have access. Approval links can be used by anyone who has them until they expire or are revoked, so share them only with the intended person.

Your content and connected accounts

You keep all rights to your content: posts, media, brand kits, messages and reports. You give us permission to store, process, display and publish it as needed to provide the service, including sending it to the social networks and AI providers you choose.

You may connect only social accounts and brands you are allowed to manage, and you are responsible for the content you publish through KariSMMa, including having the rights to every image, video, song and text.

Social networks

KariSMMa works with Facebook, Instagram, Threads, YouTube and TikTok through their official interfaces. Your use of each network remains subject to that network's own terms and policies, including the YouTube Terms of Service. Networks can change or limit their interfaces at any time, which may affect what KariSMMa can do; we are not responsible for a network's decisions, outages or restrictions on your accounts.

AI features

AI features generate text, images, video and audio from your instructions. AI output can be inaccurate, incomplete or similar to other content, so review it before you publish. You are responsible for what you publish. When you connect your own AI key, the provider's own terms and charges apply to that use.

Plans, points and payment

Paid plans are monthly subscriptions in US dollars, billed by card through Stripe. Plan prices and the points each plan includes are shown on the pricing page. Points pay for AI actions that run on KariSMMa's keys; actions on your own keys use none. Top-ups can be bought on top of an active plan.

A plan change takes effect from the next renewal. The workspace owner can cancel, update the card and see invoices in the billing portal. Prices may change; we will tell workspace owners before a change applies to them.

Acceptable use

Do not use KariSMMa to:

• publish unlawful, deceptive, hateful or infringing content, or spam;
• harass people, or send messages they did not ask for in breach of a network's rules;
• get around a network's limits or policies, or our own;
• access accounts, data or workspaces you are not allowed to;
• interfere with the service, test its security without our permission, or copy or resell it.

We may limit, suspend or close a workspace that breaks these rules or puts the service, other customers or the networks at risk.

Availability

We work to keep KariSMMa available and reliable, but we cannot promise it will always be free of errors or interruptions, or that every post will be published at the exact time, since publishing depends on the networks.

Liability

KariSMMa is provided "as is" and "as available". To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability for any claim is limited to the amount you paid us for the service in the twelve months before it. Nothing in these terms limits liability that cannot be limited by law.

Ending the agreement

You can stop using KariSMMa and cancel your plan at any time. To delete your account or workspace data, email us. We may end the agreement if you seriously or repeatedly break these terms.

Changes to these terms

We may update these terms. We will change the date at the top and, for significant changes, tell workspace owners before the new terms apply.
